How can Winns help

Winn Solicitors has a one stop shop approach to claims and will handle everything from start to finish.

We understand it is an unsettling time in the aftermath of a non-fault accident and so, naturally, you want to focus on what's important - recovery, recuperation, and a return to a form of normality.

With that in mind, we'll conduct all elements of the claim, driving forward the legal processes and procedures alongside arranging medical treatment that is appropriate and swift.

Negotiating with the third party to deliver a positive outcome, we're with you every step of the way.

How much does it cost to make a claim?

When you instruct Winn Solicitors to conduct your claim, you do so on a no win no fee basis. If we're not successful, you don't pay a penny.

This means no prohibitive upfront costs, no surprise fees as your claim progresses, and an assurance that the fee we take for our services is a fixed percentage that is agreed by you from the outset.

We do things a little differently from the rest, and will only take a fixed percentage from your personal injury compensation. Unlike with other firms, your our out-of-pocket expenses will be entirely yours.

Ready to start your claim?

The service I have received from Winns has been outstanding - my emails have been responded to promptly and always answered any questions I’ve had.

I would recommend anyone who has a case to use Winn solicitors. Thanks George and the team at Winns 👍

FAQs

What should I do after an accident at work?

If you're able to, in the aftermath of an accident, it is helpful to bring together as much evidence of the incident as possible - pictures, contact details of witnesses, a detailed retelling from your perspective - to record how it unfolded while it is fresh in the memory. The more evidence you have, the better our chances of proving liability.

Make sure your company records the accident in their accident logbook that they should have on site. It's important they make a record to ensure both you and the company accept the incident took place.

Contact a legal specialist - like the team at Winns - who can help every step of the way, driving your claim from a legal side and getting you the appropriate medical treatment quickly to get you back to a form of normality as quickly as possible.

Can I be sacked for having an accident at work?

This is perhaps one of the most prominent questions people ask when considering making a claim for an accident at work. The short answer is no, you can't be sacked for making a claim. You are protected by law on this and if you feel you have been dismissed because of this, you are legally entitled to claim for unfair dismissal at an employment tribunal.

It's important not to worry about this element of a potential claim; the company you work for won't pay directly for the compensation awarded. They'll have insurance specifically to cover these scenarios - it will be this third-party insurer who will pay out.

Will I get paid if I'm injured at work?

It is important to check the conditions of your contract of employment. Check with your HR team if they have a sickness pay programme; if not, you will be entitled to Statutory Sick Pay, but you should read into the terms and conditions to get a clearer picture of the rights applicable to you in your circumstances.

What do I need to do to make a claim?

If you have been in an accident that wasn’t your fault, there are a few valuable pieces of information which will help speed up the process of making a successful claim. When making that first call to Winns, our team member will ask relevant questions about the accident and assess what you will need to help you recover fully, both financially and physically.

Information on that initial call that would prove hugely helpful includes:

  • Details of the accident, including your version of events, and any other relevant information about the circumstances leading to the accident
  • Photos of the injuries sustained, and any photos showing the location/cause of the accident
  • The contact details of yourself and that of the company at-fault
  • Contact details for any witnesses
  • Any impact the accident has had, including physical ailments and how it will impact your day-to-day routines.

How much will a claim cost?

You pay no upfront costs to start a claim with Winns and we work on a no win, no fee basis.

We will manage all aspects of your claim and recover our costs from the other side. As long as you co-operate with the requirements of the claims process, and act honestly, then you will have no costs to pay.

How long does an accident at work claim take?

The time a claim can take depends on how complex it is. The nature and severity of the injuries sustained will be a factor, as specialist long-term treatment may be required. A client might need a new property, with specific adjustments for permanent injuries, for example and that will naturally extend the claim. We won't put a timescale on matters but be assured, our team will work diligently, efficiently, and effectively to deliver the compensation you deserve.

How much can I claim?

Although this is an important question, it isn't one that has an easy answer. The amount of compensation you could claim is based on the circumstances of the accident and the injuries sustained. The impact it has had on your day-to-day life and your future is also an important consideration. There is no standard set of amounts; each claim is unique and we treat it as such.

How long do I have to claim after an accident at work?

You have three years from the date of the accident to begin a claim for compensation. The claim doesn't need to be completed by this point but there is a legal time-limit which must be followed. There are a few exceptions to this rule, but it would be advisable to discuss your circumstances with a legal specialist to see if you're eligible.
